These terms and conditions {“Consumer Terms and Conditions”} apply to your use of the products and services you purchase from Sarah Finch Photography; including but not limited to photography sessions and gift vouchers both purchased and complementary.

We are Sarah Finch Photography, with its operating address at; Sarah Finch Photography, Regent Gardens, Didcot, OX11 8DD. The Sarah Finch Photography website has a separate Privacy Policy which applies to the use of this website and outlines how we collect, process and store any data you provide in ordering or using products or services provided by Sarah Finch Photography.

Before placing an order or securing a booking for products or services with Sarah Finch Photography, you will be asked to agree and to be legally bound by these Consumer Terms and Conditions. Please read them carefully before you submit your order. If you do not accept these Terms and conditions, Sarah Finch Photography will not be able to continue with or confirm any orders for products or services placed.

Sarah Finch Photography reserves the right to vary these Consumer Terms and Conditions from time to time. It is your responsibility to regularly review these Consumer Terms and Conditions before each purchase to keep up to date with any changes to them. If we need to revise these Consumer Terms and Conditions as they apply to your order, we will contact you to give you reasonable advance notice of the changes and to let you know how to cancel the order if you are not happy with the changes. If you opt to cancel after receipt of your notice, Sarah Finch Photography will arrange a full refund of the price you have paid for the product or service affected only.

Because you are a consumer, we are under a legal duty to supply products that are in conformity with our contract with you. As you are a consumer, you have legal rights in relation to products that are faulty or mis-described. These legal rights are not affected if you exercise your rights to cancel or by the operation of any other terms in these terms and conditions. Advice about your legal rights, including your right to cancel the contract, is available from your local Citizens’ Advice Bureau or Trading Standards office.

1.0 Purchase, Payment & Pricing 

1.1 The Website offers digital photography services and E-Gift Vouchers which may be used in exchange for photography services only.

1.2 No contract for the sale of any product or service will subsist between you and Sarah Finch Photography unless and until Sarah Finch Photography accepts your order by way of an email detailing that; payment has been received in full, the content of the product, service or E-gift voucher purchased and confirming your details. That acceptance will be deemed complete and will be deemed for all purposes to have been effectively communicated to you at the time Sarah Finch Photography sends the Confirmation to you.

1.3 You must check that the details of the Confirmation are correct as soon as possible and you should print out and keep a copy of it.

1.4 If purchasing an E-Gift Voucher, photography session, or any other product or service provided by Sarah Finch Photography, payment can be made by PayPal or bank transfer with details which will be provided at the point of placing an order. On purchasing any product or service from Sarah Finch Photography you shall receive a confirmation of receipt in the form of a confirmation email from Sarah Finch Photography. Should a physical receipt of payment or booking be required you should inform Sarah Finch Photography and we will contact you to make arrangements for this.  

1.5 You undertake that all details you provide to Sarah Finch Photography for the purpose of ordering any product or service, including, E-gift vouchers, bespoke and personalised items are correct at the time of ordering. Any errors made by you in the ordering of any products or services from Sarah Finch Photography should be communicated at the earliest opportunity. It will be at the sole discretion of Sarah Finch Photography where possible to correct any errors. Where it is not possible to correct errors made, particularly to bespoke or personalised products already ordered, you accept financial responsibility and any costs incurred for the reordering of any products in correcting any errors made by you. Please note, bespoke or personalised products are not covered by the 'distance selling laws unless otherwise found to be faulty'. 

1.6 Each product or service sold, including E-gift vouchers is subject to additional terms and conditions of use which can be viewed on the company website; alongside each individual service or product including E-Gift Vouchers, which shall apply in addition to the terms in these Consumer Terms and Conditions. All prices on the Website are not subject to VAT as this is not applicable. 

1.7 You can expect to receive any products or services ordered and digital content created usually within 2-3 weeks of the date of production.  Where Additional time is required to provide you with products or services ordered, Sarah Finch Photography will endeavour to inform you at the earliest opportunity. Due to the nature of the products and services provided by Sarah Finch Photography, you accept that delivery dates of products and services may vary. 

1.8 You accept that any order or booking for products or services provided by Sarah Finch Photography is, provided at our sole discretion and are subject to availability.

1.9 Sarah Finch Photography reserves the right to apply an additional surcharge to products or services where travel to the agreed location, where services will be undertaken are further than 40 miles from OX11 8DD. The surcharge will be agreed at the time of ordering depending on the location the services will be required. 

1.10 Sarah Finch Photography reserves the right to amend the pricing and content of any services or products provided by them at any time, with the exception of those already purchased. 

2.0 Cancellation

Should you wish to cancel a product or service purchased from Sarah Finch photography; you may do this at any time up until 14 days following its purchase. To do so, you must send a written cancellation notice via email or recorded mail. In doing so, Sarah Finch Photography agrees to refund the full amount of any moneys paid. Should you wish to cancel a product or service purchased after 14 days, you may do so at any time, but it will remain at the sole discretion of Sarah Finch Photography regarding the refund of any moneys paid.  

3.0 Reschedule

Should you wish to reschedule a product or service, including photography sessions, purchased, you should inform Sarah Finch Photography in writing at the earliest opportunity. In the instance a date is requested, all fees already paid shall be transferred to the new agreed date, subject to availability. However, where non-transferrable expenses have already been incurred by Sarah Finch Photography such as equipment hire, you agree that these expenses shall be added to the final balance due or will exist as an additional charge to be paid in full before any products or services may be carried out, should you wish to continue with the booking or service.

4.0 Model Release

These terms and conditions serve as a model release for all of those featured in any digital content produced and specifically photographs produced during photography sessions or any other photography products or services purchased. It is the sole responsibility of the individual purchasing the product or service to inform Sarah Finch Photography in writing if there are any known objections to this.

5.0 Copyright

All photographs and any other digital content produced for you by Sarah Finch Photography will remain the sole intellectual property of Sarah Finch Photography, without restriction for advertising, portfolios, and other lawful purposes. In purchasing any photography products or services you waive the right to inspect any images produced using the images or digital content produced for you.

6.0 Liability

Sarah Finch Photography agrees to make every effort to provide high quality photographic services. However, in the unlikely event that a catastrophic mechanical failure should occur to their equipment or transport and we are unable to provide you with the agreed photography services, then you agree that Sarah Finch Photography’s liability shall be limited to a full refund of monies paid to Sarah Finch Photography.

This limitation of liability also applies to any loss or damage to images, photographs or other materials listed in your order confirmation. The sole remedy for any actions or claims resulting from Sarah Finch Photography’s inability to deliver the products and services listed in your order confirmation or agreement shall be limited to a full refund of monies paid by you to Sarah Finch Photography. Any refunds processed for any reason, will only be returned to the individual who placed the original order.

7.0 Image processing & Digital Media

Sarah Finch Photography will perform limited colour correction and retouching prior to the delivery of digital copies of any content or images to you. Sarah Finch Photography is not responsible in providing printed copies of images unless otherwise agreed in writing. You may download copies of digital images from the online client gallery space, if included within your product or service purchased, within 12 weeks of receiving access to it. Following these 12 weeks, Sarah Finch Photography cannot guarantee access to it.

8.0 Gift Vouchers

As well as other photography services, Sarah Finch Photography offers digital E-Gift Vouchers which may be used in exchange for photography services only. E-Gift Vouchers are non-exchangeable for cash, and may be subject to an expiry date. It is the responsibility of the individual purchasing the E-Gift Voucher to ensure they are aware of any expiry date applied to a voucher. It is at the discretion of Sarah Finch Photography whether expired E-Gift Vouchers may be redeemed. By exchanging your voucher for the specified photoshoot, you agree to abide by the following terms:

8.1 Gift Vouchers may only be redeemed in exchange for the package displayed on the front of the Gift Voucher. And may only be used once. 

8.2 Gift Vouchers cannot be exchanged for cash.

8.3 Gift Vouchers are not refundable in part or whole after 14 days of purchase. Please see section 2.0 for cancellation terms and conditions.

8.4 Gift Vouchers may contain an expiration date, the Gift Voucher can be used at any time up to this date. After this date has passed the Gift Voucher will be invalid.

8.5 Sarah Finch Photography is under no obligation to accept a Gift Voucher that has expired. In certain circumstances we may accept a Gift Voucher that has expired but that is at the sole discretion of Sarah Finch Photography.

8.6 Gift Vouchers should be treated as cash, Sarah Finch Photography accepts no liability for lost, stolen or damaged Vouchers. 

8.7 Sarah Finch Photography will only accept use of the E-Gift Voucher upon presentation of the voucher code.

8.8 Sarah Finch Photography reserves the right to amend the Gift Voucher Terms & Conditions at any time and take appropriate action, including the cancellation of the Gift Voucher if it deems such action necessary. This does not affect your legal rights. Please see section 2.0 for cancellation policy and the introduction for more information regarding changes to these terms and conditions, and our policy in informing you. 

8.9 Gift Vouchers cannot be traded for Gift Vouchers.

8.10 Usage of the Gift Voucher or any other photography product or service signals your acceptance that Sarah Finch Photography cannot guarantee certain poses during the photography session. Additionally, you may not hold Sarah Finch Photography liable for compromised or poor-quality images due to lack of cooperation by image subjects or environmental issues, such as poor event lighting, space, or backdrops.

8.11 Once your order has been processed by Sarah Finch Photography, we shall be responsible for issuing the E-Gift Voucher by e-mail and performing any other terms set out in the Confirmation. Please allow seven (7) days for delivery during peak times. There is no dispatch on UK bank holidays or weekends. Sarah Finch Photography does not accept liability for any delay which may occur in the delivery times which are due to circumstances outside our control. You may cancel an order in such circumstances.
